Custom Love Song – Terms of Service & Usage Rights

1. Nature of the Service

The Custom Love Song is a one-of-a-kind creative work written and produced based on information provided by the couple and the artistic interpretation of the DJ. Each song is unique and created as an expressive, individualized artistic product rather than a standardized or templated composition.

Because of the creative nature of this service, outcomes may vary in style, structure, length, and emotional tone.

2. Intended Use

The Custom Love Song is created for personal enjoyment and event use, including but not limited to:

There is no required or prescribed use. Couples may choose how and when their song is shared or experienced.

3. Public Sharing & Uploads

Couples may choose to share their Custom Love Song publicly, including on social media or personal websites, at their discretion.

Due to the evolving nature of automated copyright enforcement systems used by third-party platforms, America’s Wedding DJ & Photo Booth cannot guarantee acceptance, protection, or uninterrupted availability on external platforms.

Any copyright claims, takedown notices, content ID matches, disputes, or enforcement actions initiated by third-party platforms are the responsibility of the uploader. America’s Wedding DJ & Photo Booth is not liable for platform enforcement actions, content removal, or disputes once the song is shared publicly.

4. Unauthorized Third-Party Use

Once a Custom Love Song is shared publicly, America’s Wedding DJ & Photo Booth cannot control or prevent unauthorized copying, redistribution, or use by third parties. The DJ is not responsible for theft, misuse, or redistribution of the song following public release.

5. Creation Process & Version Selection

Each Custom Love Song is a uniquely created, individualized work inspired by the information provided and the creative interpretation of the DJ. Because of the nature of this creative process, individual elements of a song cannot be edited or modified once created.

Any requested changes require the creation of a new version, which may differ significantly in melody, structure, lyrics, or overall feel from prior versions. Results of recreated versions cannot be guaranteed to resemble earlier versions.

As part of this service, the DJ will create and approve up to two complete song versions for client review. The client may select one final version to be delivered as their Custom Love Song.

If the client wishes to retain both versions, the second version may be purchased at an additional cost equal to 50% of the original Custom Love Song price.

Each version is a complete and independent creative work.

6. Delivery Format

The final Custom Love Song will be delivered as a single mastered audio file suitable for playback and event use. File format and delivery method will be determined by the DJ.

Source files, alternate versions, instrumental-only versions, or project files are not included unless otherwise agreed upon in writing.

7. Delivery Timing

Delivery timelines may vary based on event date, production schedule, and creative considerations. Specific delivery timing will be discussed during planning but is not guaranteed to follow a fixed timeline.

8. Emotional Response

Music is inherently subjective. While many couples find the experience deeply meaningful, emotional impact cannot be guaranteed and does not constitute grounds for refunds, re-creation, or additional revisions beyond what is outlined above.

9. File Retention & Intellectual Property Protection

To protect client privacy and limit liability, America’s Wedding DJ & Photo Booth does not retain working files, drafts, or supporting materials related to a Custom Love Song beyond what is reasonably necessary for delivery and agreed-upon revisions.

Once the final song has been delivered and accepted, interim materials, notes, and project files may be removed from active records. Long-term archival storage of drafts, lyrics, or alternate versions is not guaranteed.

Clients are responsible for preserving their final delivered song.

The Custom Love Song is provided as a creative service and is not a licensed commercial music product.

11. Acceptance of Terms

By proceeding with the Custom Love Song service, the client acknowledges and agrees to these Terms of Service & Usage Rights.
